1. Introduction
These Terms and Conditions govern your access to and participation in classes, memberships, and related services offered by FORM Somerset Pilates Pty Ltd (“FORM Somerset Pilates”, “we”, “us”, or “our”).
By booking or attending a class, purchasing a membership, or otherwise using our services, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use our services.
1.1 Definitions
In these Terms:

“Client” / “you” / “your” means any person purchasing or participating in services provided by FORM Somerset Pilates.

“Services” means all Pilates classes, memberships, workshops, studio access, and related offerings provided by us.

“Momence” means the third-party booking, scheduling, and payment platform used to manage client memberships, payments, and class bookings.

“Terms” means these General Terms and Conditions, as amended from time to time.
2. Memberships and Class Access
2.1 Membership Options
We offer a range of memberships, class packs, and casual class options, each with specific inclusions, pricing, and expiry dates. Expiry periods vary by package type and are detailed at time of purchase via Momence.
Full details are available on our website or via the Momence platform.
Memberships will begin on the date of purchase, while package credits and expiry periods will activate upon first booking or use.
Memberships may include access to reformer and/or mat Pilates classes and renew automatically unless cancelled in accordance with clause 6.
3. Pricing & Payments
3.1 Payment Processing
All payments are processed securely through Momence or its integrated payment processor (Stripe).
We do not store full payment or card details.
By signing up, you authorise us to debit your nominated account for all fees associated with your membership, class pack, or purchases.
Payments are debited weekly. Please ensure sufficient funds are available on the direct debit date.
Please note transaction fees apply:
• Card payments incur a fee of 2.7% + $0.30 per transaction.
• Bank account/Direct debit payments incur a fee of 2% + $0.30 per transaction.
Please note: Transaction fees are applied at the time of payment and added to your total. The fee amount will be shown in your payment confirmation from Momence.
3.2 Failed Payments
If a payment fails, your account may be suspended, and a $10 dishonour fee may apply.
You will be notified via Momence and access will be reinstated once the account is up to date.
3.3 Price Changes
We may update membership prices or billing terms with 30 days’ written notice.
If you do not accept the new pricing, you may cancel your membership under clause 6.
3.4 Merchandise and Gift Cards
We may offer merchandise and gift cards for purchase.
Gift cards are valid for the amount shown, are non-transferable, and cannot be redeemed for cash. Gift cards are valid for 3 years from the date of purchase, in accordance with Australia Consumer Law.
Refunds are not provided for merchandise or gift cards unless required by law.
4. Class Bookings & Attendance
4.1 Booking System
All classes must be booked via Momence.
It is your responsibility to book within your membership or pass entitlement.
Class credits do not roll over unless otherwise stated. Unused credits from recurring memberships do not accumulate.
We reserve the right to reschedule or cancel classes as needed. Reasonable notice will be given where possible.
4.2 Arrival and Attendance
Please arrive at least 5 minutes before your class start time.
For safety reasons, clients arriving more than 5 minutes late may not be permitted to join and will forfeit the session.
4.3 Trainer & Class Changes
Class schedules and instructors are subject to change without prior notice. In the event a class needs to be cancelled, we will make every effort to notify you as soon as possible. Any prepaid sessions affected by a cancellation will not be forfeited.
4.4 Studio Conduct

Clients under 18 must have a parent or legal guardian complete and sign our Participant Waiver and Risk Acknowledgement on their behalf before participating.

We reserve the right to refuse entry or remove anyone who behaves in a disruptive, unsafe, or disrespectful manner.

Socks are required for all reformer sessions.

Mobile phones must be silenced during classes.

FORM Somerset Pilates is not responsible for personal belongings brought into the studio.
4.5 Introductory Offers
Introductory or trial offers are for new clients only unless stated otherwise.
They are non-transferable, non-refundable, and subject to expiry periods.
5. Cancellations & No-Show Policy
5.1 Class Cancellations
Classes must be cancelled at least 4 hours before the scheduled start time.
How to Cancel:

Use the Momence app or our website to withdraw from the class

We cannot accept cancellations by phone, email, or social media
CANCELLATION FEES
-
Early Cancel (4+ hours before) = No charge, credit retained. Thank you for being considerate!

Late Cancellation (Within 4 hours) = Session credit forfeited
-
No Show (Don't attend, don't cancel) = Session forfeited + $10 fee (after first occurrence)
5.2 Waitlist Policy
When a class is full, you can join the waitlist.
If a spot opens up:

You’ll receive a notification

You have 20 minutes to confirm your booking

Upon accepting the spot, an immediate charge/credit deduction will occur

If you don’t respond in time, the spot goes to the next person
Tip: Ensure your notifications are turned on in the Momence app or via email so you don’t miss your chance.
5.3 Suspension of Access
We may suspend or restrict account access for repeated no-shows, unpaid balances, or misuse of the booking system.
6. Membership Holds & Cancellations
6.1 Membership Holds
Memberships can be placed on hold for up to 3 months per calendar year, with a minimum of 1 week at a time.
Requests must be emailed to admin@formsomersetpilates.com at least 3 days before the intended hold start date. Please allow up to 48 hours for processing.
6.2 Membership Cancellations
There is no minimum membership commitment, however membership payments will continue until FORM Somerset Pilates is notified of cancellation. Memberships may be cancelled with 30 days’ written notice via email. The 30-day period begin from the date we confirm receipt of your cancellation email. You will continue to have access to classes during this period, and any scheduled payments will be processed as normal.
7. Health, Safety & Risk Acknowledgement
7.1 Health Disclosure
Before participating, you must disclose any injuries, illnesses, or conditions (including pregnancy).
You should seek medical advice before starting any exercise program.
By participating, you confirm you are physically able to engage in Pilates safely.
7.2 Voluntary Participation
Participation in classes is voluntary and at your own risk.
You must follow instructor guidance and use equipment responsibly.
If you feel pain or discomfort, stop immediately and notify your instructor.
7.3 Liability Waiver
To the extent permitted by law, FORM Somerset Pilates, its employees, and contractors are not liable for any injury, loss, or damage arising from participation, except where caused by our negligence.
We comply with the Australian Consumer Law, and any guarantees that cannot be excluded will be honoured.
8. Photography and Social Media
By attending classes or using our facilities, you consent to FORM Somerset Pilates capturing and using photos or videos for promotional purposes, including social media. We respect your privacy and will not share sensitive information. If you prefer not to be featured in photos or videos, please email admin@formsomersetpilates.com and notify us at reception.
Clients must not photograph or record instructors or other participants without their express consent. This helps us maintain a respectful and secure environment while celebrating our community.
9. Privacy & Personal Information
We manage your personal information in accordance with our Privacy Policy, available at www.formsomersetpilates.com.
By booking or purchasing through Momence, you consent to the collection and handling of your information in line with that policy.
10. Studio Etiquette

Arrive early and wear suitable activewear.

Be respectful of instructors and other members.

Keep the studio tidy and use equipment safely.

Notify staff immediately of any hazards or concerns.
We reserve the right to cancel memberships or refuse service for unsafe or inappropriate behaviour.
11. General Provisions
11.1 Amendments
We may update these Terms from time to time.
Changes will be communicated via our website, Momence, or email. Continued use of our services constitutes acceptance of the revised Terms.
11.2 Entire Agreement
These Terms, along with our Privacy Policy and Waiver, form the entire agreement between you and FORM Somerset Pilates.
11.3 Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect.
11.4 Force Majeure
We are not liable for any delay or failure to perform due to causes beyond our control, including natural disasters, government restrictions, pandemics, public health emergencies or software outages (e.g. Momence downtime).
11.5 Governing Law
These Terms are governed by the laws of Queensland, Australia, and you agree to submit to the exclusive jurisdiction of the courts of Queensland.
